TN Visa Requirements


The TN visa was created under the North American Free Trade Agreement between Canada, U.S. and Mexico. Under this visa, a Canadian citizen may work in a professional occupation.

Requirements

The nonimmigrant NAFTA Professional (TN) visa allows citizens of Canada, as NAFTA professionals, to work in the United States in prearranged business activities for U.S. or foreign employers. Canadian professionals may enter the United States under NAFTA without the requirements of a petition approval required in the H-1 category; Canadian professionals are designated as TN-1 nonimmigrants. Professionals of Canada or Mexico may work in the U.S. under the following conditions:

• Applicant is a citizen of Canada or Mexico;
• Profession is on the NAFTA list;
• Position in the U.S. requires a NAFTA professional;
• Mexican or Canadian applicant is to work in a prearranged full-time or part-time job, for a U.S. employer. Self employment is not permitted;
• Professional Canadian or Mexican citizen has the qualifications of the profession

Permanent residents, including Canadian permanent residents, are not able to apply to work as a NAFTA professional.

Spouse and Children of NAFTA Professionals

Canadian citizen spouses and children of a NAFTA Professional usually do not need a visa to join the NAFTA professional in the United States. Upon entry they would, however, need to show a valid Form I-94 from the principal TN visa holder to prove that the professional is maintaining TN visa status. Non-Canadian citizen spouse and children would need a visa to be able to accompany or join the NAFTA Professional, as TD visa holders.

Documentation

You must ensure you have the necessary documentation to establish your identity and purpose of entry and prove that you are eligible for a TN Visa. This is the basic documentation requirement you must have at a U.S. port of entry:

• Request for admission under TN status to Department of Homeland Security, Customs and Border Protection, U.S. immigration officer;
• Employment Letter - Evidence of professional employment.
• Proof of professional qualifications, such as transcripts of grades, licenses, certificates, degrees, and/or records of previous employment;
• Proof of ability to meet applicable licensure requirements;
• Proof of Canadian citizenship- Canadian citizens may present a passport, as visas are not required, or they may provide secondary evidence, such as a birth certificate. However, Canadian citizens traveling to the United States from outside the Western Hemisphere are required to present a valid passport at the port-of-entry;
• Filing fee of U.S. $50 USD
• Form I94 fee - $6 USD

A Canadian individual must be coming to the U.S. to work temporarily in one of the professions listed in the appendix to the North American Free Trade Agreement. Here are the listed professions:

Animal Scientist

Architect (Baccalaureate Degreeor state/provincial license. Also see Landscape Architect, below)

Computer systems analyst who must have: Baccalaureate Degreeor post secondary diploma *and three years' experience

Disaster Relief Insurance Claims Adjuster who must have: Baccalaureate Degreeor 3 years' experience in claims adjustment, and completed training in appropriate areas of insurance adjustment pertaining to disaster relief claims.

Engineer (Baccalaureate Degreeor state/provincial license)
Entomologist
Epidemiologist

Graphic Designer who must have: Baccalaureate Degreeor post secondary diploma and three years' experience.
Horticulturist
Hotel Manager who must have: Baccalaureate Degreein hotel/restaurant management, or post secondary diploma in hotel/restaurant management, and three years' experience in hotel restaurant management.
Industrial Designer who must have: Baccalaureate Degreeor post secondary diploma and three years experience.
Interior Designer who must have: Baccalaureate Degreeor post secondary diploma and three years' experience.
Land Surveyor (Baccalaureate Degreeor state/provincial/federal license)
Landscape Architect
Lawyer (member of state/provincial bar, or LLB, JD, LLL, or BCL)
Librarian (MLS, or BLS. BLS must be one for which another Baccalaureate Degree was a pre-requisite)
Management Consultant who must have: Baccalaureate Degreeor five years' experience in consulting or related field.
Mathematician
Medical Technologist/Medical Lab Technologist (Canada) who must have: Baccalaureate Degreeor post secondary diploma *and three years' experience. (U.S. job must be in a laboratory to perform chemical, biological, hematological, immunologic, microscopic, or bacteriological tests, and analyses for diagnosis, treatment or prevention of disease)
Meteorologist
Nurse, Registered (must have state/provincial license)
Nutritionist
Occupational Therapist (Baccalaureate Degreeor state/provincial license)
Oceanographer
Pharmacist (Baccalaureate Degreeor state/provincial license)
Pharmacologist
Physician (teaching and/or research only, MD or state/provincial license)
Physicist
Physio/Physical Therapist (Baccalaureate Degreeor state/provincial license)
Plant Breeder
Poultry Scientist
Psychologist (must have state/provincial license. Cannot qualify with just Baccalaureate Degree)

Teacher (Baccalaureate Degree: must be coming to work for a college, seminary or university only); no secondary or elementary school teaching.
Technician or Technologist, Scientific (E.g.: Electronic engineering technician.) who must: work in direct support of professionals in one of these disciplines: biology, chemistry, engineering, forestry, geology, geophysics, meteorology, physics OR possess theoretical knowledge of discipline, and solve practical problems in discipline, or apply principles of the discipline to basic or applied research
Urban Planner
Veterinarian (DVM, DMV, or state/provincial license)
Vocational Counsellor
Writer, Technical Publications (Technical Publications Writer) who must have: Baccalaureate Degreeor post secondary diploma and three years' experience.
Zoologist
